Terms of Service

The Aflink service (aflink.io and app.aflink.io) is owned and operated by Fungies Europe Prosta Spółka Akcyjna (P.S.A.) — a simple joint-stock company incorporated under Polish law and registered with the National Court Register (KRS).

Throughout this document, "Aflink", "we", "us", and "our" refer to Fungies Europe P.S.A. unless explicitly stated otherwise.

These Terms form a legally binding agreement between you (“Customer”) and Aflink. If you accept on behalf of a company, you represent that you have authority to bind that entity. If you do not agree, do not use the service.

Aflink provides software-as-a-service. You remain the controller of any personal data you upload; we act as your data processor in accordance with our Data Processing Addendum (available at support@fungies.io).

• You must be at least 18 years old and legally able to enter contracts.
• You must provide accurate registration information and keep it up to date.
• You are responsible for the activity that happens under your account, including the actions of every team member you invite.
• You must immediately notify us of any unauthorised access at support@fungies.io.

• Pricing for each plan is shown at app.aflink.io and on the public pricing page. Stripe and Fungies fees are passed through at cost.
• Subscriptions renew automatically each billing cycle until cancelled. You can cancel at any time from your account dashboard — access continues until the end of the paid period.
• All fees are exclusive of VAT and other applicable taxes, which we will add where required.
• Late or failed payments may suspend the account after a 7-day grace period; data is retained for 60 days from suspension before deletion.
• Refunds are at our discretion and only for amounts paid in the previous 30 days for material service failures.

You agree not to use Aflink to do, or attempt, any of the following:

• Promote illegal goods or services, hate, harassment, or sexually explicit content involving minors.
• Run attribution programs in regulated industries (gambling, prescription drugs, weapons, crypto/MLM) without our prior written approval.
• Send spam or unsolicited messages, scrape data, or operate bots from your affiliate links.
• Reverse-engineer, decompile, or attempt to extract source code from our services.
• Bypass security controls, rate limits, or access systems you are not authorised to access.
• Generate fake clicks, signups, or conversions to defraud advertisers or affiliates.

You retain all rights to the brand assets, copy, audience data, and program rules you upload (“Your Content”). You grant Aflink a non-exclusive, worldwide licence to host, transmit, and display Your Content solely to operate the service for you.

• You are solely responsible for the legality and accuracy of Your Content, including any commission terms you publish to affiliates.
• You are responsible for paying out approved commissions to your affiliates. Aflink facilitates payouts through Stripe Connect and Fungies but is not the merchant of record unless you have explicitly chosen Fungies as your MOR.
• You are responsible for tax reporting obligations to your affiliates (1099-NEC, DAC7, etc.) — we provide tools, not legal advice.

Aflink, the Aflink logo, the marketing copy on aflink.io, and the underlying software are owned by us and our licensors. We grant you a limited, revocable, non-transferable licence to access and use the service during the term of these Terms. All other rights are reserved.

You may submit feedback or suggestions; you grant us a perpetual, royalty-free licence to use that feedback to improve the service without obligation to compensate or attribute you.

Each party will protect the other party’s confidential information with at least the same degree of care it uses for its own (and never less than reasonable care). Confidentiality obligations survive termination for 3 years; trade secrets remain protected for as long as they qualify as such.

Aflink integrates with third parties including Stripe, Fungies, Resend, Supabase, Vercel, and Cloudflare. Your use of those services is governed by their own terms. We are not responsible for outages, errors, or policy changes at any third party, but we will help you migrate or mitigate where commercially reasonable.

We warrant that we will use commercially reasonable efforts to maintain the service in accordance with our public Service Level commitment (99.9% monthly uptime measured at the API edge). EXCEPT FOR THIS WARRANTY, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, secure against every attack, or that it will produce specific business outcomes (clicks, conversions, revenue).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING OUT OF OR RELATED TO THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability arising out of or related to these Terms will not exceed the greater of (a) the fees you paid us in the 12 months before the event giving rise to liability, or (b) one hundred euros (€100). Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be limited by law.

You will defend, indemnify and hold Aflink harmless from any third-party claims, damages, fines or costs arising out of (i) Your Content, (ii) your breach of these Terms or applicable law, (iii) commission disputes between you and your affiliates, or (iv) tax obligations you fail to fulfil.

• These Terms apply for as long as you have an active Aflink account.
• You may terminate at any time by deleting your account in the dashboard.
• We may suspend or terminate immediately for material breach (including non-payment after the grace period, abuse of acceptable-use policy, or threats to platform security).
• On termination we delete your data within 30 days, except where retention is required by law (tax, audit, AML, KYC).

These Terms are governed by the laws of the Republic of Poland, excluding its conflict-of-laws rules and the UN Convention on the International Sale of Goods. Disputes will be resolved exclusively by the competent courts of Warsaw, Poland — except that consumers retain any mandatory protections of their country of residence.

We may update these Terms as the product and the law evolve. Material changes will be announced by email and on this page at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
